DUI law in California is seemingly in a constant state of change.  The change is brought on mostly from political pressure and funding through special interest groups, namely the MADD organization.  At any case here’s  a basic outline of California DUI law as it stands today:

When arrested and charged with DUI in the state of California normally the suspect is charged with (2) offenses:

  • 23152(a) misdemeanor to drive under the influence of alcohol and/or drugs.
  • 23152(b) misdemeanor to drive with .08% (BAC) or more of alcohol in your blood.
  • Again, the suspect is more often than not accused of breaking both laws even though only 1 incident occurred.  California DUI law states that they can be convicted of BOTH offenses as well.
