In Arkansas, driving under the influence (DUI) is actually referred to as DWI, or Driving While Intoxicated.  So for reference we will refer to the associated laws as Arkansas DWI Law.

After being pulled over and arrested for suspicion of DWI in Arkansas it’s vitally important for you to request a DMV hearing within 7 days of the stop or your drivers license will automatically be suspended 30 days after your arrest.  Even if you do not plan to contest the charge it is a good idea to schedule the DMV hearing anyway and speak to a DWI lawyer in Arkansas to get some legal advice about how to proceed.

A 1st Offense DWI in Arkansas carries the following punishments:

1.  Up to 365 days in jail

2.  Fine from $150 up to $1,000 (plus court costs of $300).  NOTE:  The court can assign public service duties in lieu of jail time at their sole discretion (this is where a good Arkansas DWI lawyer can make a difference).

3.  120 day license suspension (as long as breath test BAC was below .18)  Eligibility for restricted license depends on the case.

A 2nd Offense DWI in Arkansas carries the following punishments:

1.  From 7 days up to 365 days in jail. 

2.  Fines from $400 up to $3,000.  (plus $300 court costs)

3.  NO less than a 30 day community service obligation.

4.  License suspension for 24 months (if 2nd offense DWI in Arkansas was within 5 years of first).  After a 1 year waiting period you may be eligible for installation of an interlock device and a restricted drivers license.
