In New Mexico a DUI or DWI arrest triggers 2 seperate actions, an administrative one and a criminal one. The state driving authority will attempt to suspend or revoke your driving privileges while the criminal courts will levy heavy fines, punishments and possibly jail time.
Here’s what you can expect for a 1st offense DWI in New Mexico;
Possible costs and fines: $2,025.00+ not including increased insurance, treatment, lost wages, towing and storage and court costs.
Jail Time: 0-90 days; 48 Hours Mandatory Jail Time if convicted of Aggravated 1st DWI. Mandatory 48 Hours if offender fails to comply with the sentence of the Court.
Criminal License Revocation: 1 year unless offender is sentenced to and completes DWI school.
Effective June 17, 2005, an Ignition interlock must be installed on all vehicles driven by the offender for at least one year If convicted of DWI.
The Ignition Interlock fee is roughly $960 per year or more.
The criminal license revocation is separate from Motor Vehicle Department (Administrative) revocation. It is possible to win your criminal case and still be revoked by MVD; likewise you can win your MVD Hearing and still face the criminal license revocation.
Here’s what you can expect with a 2nd offense DWI in New Mexico;
Possible costs and fines: $6,365 not including increased insurance, treatment, lost wages, towing and storage and court costs.
Jail Time: 3-364 days (72 HOURS MANDATORY); Additional 96 Hours Mandatory if convicted of Aggravated 2nd DWI; Mandatory 7 Days if offender fails to comply with the sentence of the Court.
Criminal License Revocation: 1 year
Ignition Interlock Fee: roughly $960 or more
If ordered by the Court: Up to 5 Years Probation; Up to 5 years with Ignition Interlock;
