Time is of the essence immediately after you are arrested for Drunk Driving or more commonly referred to as a DUI or DWI depending on what state you are in. Here i’ll list a few things for you to keep in mind that are time sensitive based on the date of your DUI arrest.
First, take a look at the piece of paper that the cop gave you or that you got upon your release from jail that serves as your temporary license. Normally the piece of paper is pink and it states that you have a certain amount of days to schedule your DMV hearing to contest the suspension of your drivers license. Normally the amount of time is 10 days but check the paper license to be sure.
On that piece of paper is also a telephone number that you need to call to schedule a DMV hearing. You do not need a lawyer to do this for you! Even if you plan on retaining a DUI lawyer to assist you with your charge (you should) you should still go ahead and make this phone call on your own and schedule the hearing. You only have 10 days so go ahead and do it immediately!
Scheduling this hearing will delay the suspension of your license until the hearing date. If you do not schedule the hearing your license will automatically be suspended on the date that the paper license expires.
The next time sensitive issue to keep in mind is your court date. This is different then your DMV hearing date. All the matters with the DMV are considered “civil” and the matters with the courts are considered “criminal.” So don’t confuse the two, they are 2 seperate issues for you to deal with.
