		<description>As a repeat offender myself. I do understand that there should be stiffer penalties for your first offense and especially so for repeat offenders. Ive been charged for five dui offenses over 18 years and reduced 3 of them to a lower dui offense while beating 1 down to a wreckless driving. I am not proud of any and have been fortunate to not have been involved in any where it has involved an accident but nevertheless it scares me looking back on them to this day. I didnt take serious action to my own problem before my last dui because I wasnt facing a stiff enough penalty under a 1st or even a 2nd offense. I just hired good lawyers, paid them up front, considered myself guilty till they got reduced charges. My lawyers usually caught the officers involved lying under oath and therefore reduction of charges. This is usually the case for most offenders getting off. Im not trying to bash anyone here but in reality its the stupid things that get you caught and ironically the stupid mistakes by officers that get you off. There is serious politics involved with the courts too. As most prosecuters would rather throw a plea bargain versus go to trial. Very well known to all who have some balls to take them on. The truth!!!! Almost no attourney or judge likes to go the distance when there is an easier way out. I have completely changed the way I live my life as a sobre law abiding citizen for long enough to say that under any doubt of that I just look up a 3rd 4th or 5th offense and then I get real again. If penalties get stiffer then you take certain money makers out of the picture? You see there are solutions but no way are they going to change. Put Intox-a-lock systems in new vehicles!!!! Too much money to be made by the machine in place. I never heared of a 4th or 5th offense before. Why so many? Its a big $$$$$ game. There are actually 9 if you consider non aggrivated and aggrivated. Make new vehicles with breathilizers like seatbelts. This is 2011? Right? Not going to happen. $$$$$ machine is too big. Same time they want you off the street with all the P.R on commercials. They need the repeat offenders $$$$$$. I didnt make this up. Look at the court records. A 2nd offense on the aggrivated side is a stiffer penalty than a 3rd on the non aggrivated. It was no accident. Not that many laywers missed that before law. The courts make bank on dui cases. Its a win win all the time. Hmmm? Here the ole saying? (Dont bite the hand that feeds you)? Think the State really wants to change that? Looks good on TV. Middle aged white guy that can afford the good attourney getting caught for a dui? With the famous saying? WE WILL FIND YOU. They need that revenue. Poor police officer buys in that he or she is fighting crime? Drugs? Same thing. Like I said. I am not trying to bash anyone person here but you have to look at the bigger picture. Jesus!! Look at the former South Dakota Governor!!! Killed those people on their bikes after blowing through a 4way stop sign at around 2pm in the sunny afternoon and kept going with no consequences to face and on top of that!!!!! Blew 3xs the legal limit. I am very happy that you were able to walk away from your accident.</description>

		<description>This 4th of July I was in an accident involving a drunk driver.  He ran a stop sign and came right out infront of me and we collided with me going a speed of 55-60 mph.  The man was taken to the hospital and placed under arrest.  He was at the time 3.5 times the legal limit and it was his 12th arrest for DUI.  He made bond, will probably get a slap on the wrist, a fine, and maybe get his license suspended.  I don&#039;t believe this is enough for a repeat offender like him, but because you can&#039;t make exceptions for anyone this man has slipped through the cracks of the system and will get a light consequence.  
I would like to see NE take steps in changing the penalties for drunk driving to include double the fines, and even call the 3rd offense a felony.  Three strikes and you are out.  No exceptions.  How many chances will one person get to kill someone.  I was extremely lucky to walk away from my accident with seat belt bruises and a sore shoulder.
Another thing that the NE law should not allow is for an individual to bundle multiple arrests into one offense.  He has managed to squeeze 12 arrests into 4 offenses.  Two of which have dropped off because of the 12 year rule.  If this hadn&#039;t been in place this individual would never have had the chance to hit me.  I don&#039;t mind that NE allows for the offenses to disappear from your record after a time, but I think for that to happen they should have to go through programs and provide proof that they have sobered up and they are not repeat offenders, but the man that hit me has not proven anything and after 12 years he recieved the equivalent of a &quot;get out of jail free&quot; card.  
Drunk driving is an unacceptable offense and there is no need for it to be taken as lightly as it seems to be.  There needs to be a change and the sooner it happens the better it will be for everyone.</description>
