A Georgia man has been given five years’ probation for driving with a suspended license after the DUI case against him was dropped by the prosecutor in Richmond County. The case for DUI against Roderick Tolbert was dropped because he was arrested by a deputy who has since claimed he falsified DUI breath tests he had administered in the past. The field sobriety test given showed he was driving under the influence of marijuana.
The deputy, Eric Norman, is not sure which breathalyzer tests he altered in the course of his duty, but admits to only doing it twice. An experienced Georgia DUI attorney would of course question any evidence that this deputy would provide during a trial possibly leading to reasonable doubt about guilt. This case will probably not be the last to end this way as there are at least ten more cases involving the deputy awaiting trial.
If you went into court alone you would likely have no idea that this deputy had this problem in other cases. An experienced Georgia DUI attorney would have this name along with the names of any other arresting officers who may have used questionable methods in the past. That is just one of the many strategies Georgia DUI lawyers can bring to the courtroom to bolster your defense and provide you with a better chance of a favorable verdict.
