			<content:encoded><![CDATA[<p>The vast majority of people who drink and drive would be considered “social drinkers”, meaning they might: </p>
<p>Go to the bar after work with their fellow coworkers and have one or two glasses of wine or beers.</p>
<p>Go out to dinner with friends or family and have a couple drinks with their meal.</p>
<p>Go to a party and have a drink or two over the course of the evening.</p>
<p>Whether you consider yourself a “social drinker” or drink alcohol on a regular basis there are some simple steps you can take right now to minimize your chances of being involved in a <strong>DUI</strong> stop.</p>
<p>1. Put some cologne or perfume in the center console of your car. The cologne or perfume needs to be on the more expensive end since the cheaper brands you can get at Wal-mart tend to wear off quickly and are not as potent. The whole purpose of using the cologne or perfume is to mask the scent of the alcohol on your person and in your vehicle.</p>
<p>Apply the cologne, preferably using a spray bottle, to yourself from head to toe after you have been drinking, but before you drive a vehicle. Also spray it around the interior of the vehicle to mask the scent in the vehicle.</p>
<p>2. Keep some breath aids in your car at all times. You don’t want to skimp on price here either. Buy some gum or mints that are fairly strong and will actually work like nu-breath or something similar.</p>
<p>The breath mints will not only mask the scent of the alcohol on your breath, but will also slightly slur your speech due to the sucking and chewing action. A person who has been consuming alcohol will typically have slurred speech patterns.</p>
<p>So here again, the officer will have a problem picking up on a slurred speech pattern due to alcohol consumption because you are sucking or chewing on a breath mint.</p>
<p>3. Spray the interior of your car with an air freshener before driving. Here again, use a more expensive air freshener then you would normally use. This needs to be a spray air freshener and not one of those scented pine trees you hang from your rearview mirror.</p>
<p>By using all three of the above suggestions in combination you can greatly reduce your chances of being arrested for <strong>DUI</strong>. Just the slightest hint of alcohol on you or in your vehicle during a routine traffic stop, can turn into a <a href="http://www.duiarresthelp.com">DUI arrest</a>. So as Ben Franklin once said, “An ounce of prevention is worth a pound of cure”.</p>

			<content:encoded><![CDATA[<p><strong>Drunk driving laws</strong> across the United States are only going to get tougher and more restrictive in the coming years. When you have state lawmakers who assume that the public is not truly aware of the dangers of drinking and driving, they feel that they need to enact tougher drunk driving laws to protect the public.</p>
<p>We’ve all seen the show “Cops” and all the other law enforcement type programs that are on television today where they show an officer stopping someone on suspicion of DUI and the person has obviously had way too much to drink and shouldn’t be driving anyway.</p>
<p>The officer subjects the person to the <a href="http://www.duiarresthelp.com/field-tests.php">field sobriety tests</a>, which of course the person fails miserably. All while being filmed for television because this is what our society wants to see when they turn on their televisions in this day and age.</p>
<p>And it is from viewing stuff like this that the majority of the public base their opinion on drunk driving and the lawmakers know this and they feed off this.</p>
<p>I like to relate this to the way that most people in our country decide to vote for the next President of the United States. They see all the political ads on television and in the newspaper and make their voting decision for the next President based on this type of information.</p>
<p>What the public never sees or hears about is all of the people who have been arrested for DUI who were not actually over the legal limit or for that matter had even been drinking alcohol.</p>
<p>Lets say that you’re driving down the road and you are kind of wandering in your lane, but you are not crossing the line. If an officer sees this type of behavior, this is probable cause to stop you on suspicion of DUI.</p>
<p>Or if an officer is behind you and is going to perform a traffic stop on you because lets say you failed to come to a complete stop at a stop sign. You being a good citizen see the officer’s lights and look for a spot to pullover so that you are out of the flow of traffic and harms way.</p>
<p>Lets say it takes you half a mile to find an acceptable spot to pull over. This is another case where the officer can perform a <strong>DUI</strong> check because you were slow to pullover.<code></code></p>
<p>There are a lot of scenarios like this that play out across our country everyday. So even if you are reading this post and haven’t been convicted of a DUI, now is a good time to read up on your home states <a href="http://www.duiarresthelp.com">DUI laws</a>, you never know when you might need to use your <strong>DUI</strong> knowledge.</p>

<p>Everyone knows that you have to advertise your business to the general public otherwise they will never know that your business exists. It doesn’t matter whether you run a beauty salon, daycare or you are a <strong>DUI lawyer</strong>, if you don’t advertise your business, it will cease to exist.</p>
<p>Just because a lawyer specializes in <strong>DUI cases</strong> doesn’t mean that they are telling the general public that it’s ok to drink and drive.</p>
<p>The lawmakers are also trying to attach legislation to the DUI Advertising bill that would create a <strong>repeat DUI offender list</strong> that anyone could access via the Internet just like a person does to find out about sex offenders living in their neighborhood or town.</p>
<p>Don’t think for a minute that you’re safe just because you don’t live in Tennessee. Once a bill like this passes in one state, it’s just a matter of time before it reaches the state where you live.</p>
<p>It is appalling that our government has gotten to the point where they are going to start dictating how a person can advertise their business. What a complete waste of taxpayer dollars! There are much more important issues that need to be addressed other than how a <a href="http://www.duiarresthelp.com/dui-lawyers.php">DUI lawyer </a>advertises their professional services.</p>

<p>There should also be a tow location on there where your vehicle is being held… if not call the police station and ask them where it is.</p>
<p>2. <u><strong>Review all the paperwork</strong></u> you were given by the arresting officer and the police station upon release. You should have:</p>
<p><font face="Symbol"><font face="Times New Roman">**A pink piece of a paper that authorizes you to drive (since your license was most likely confiscated). </font></font></p>
<p><font face="Symbol"><font face="Symbol"><font face="Times New Roman">**A citation stating the offenses you are being charged with. The charges depend on the state you’re located in and the specifics of your case… but in standard drunk driving cases you’ll likely see 2 charges for 1 offense. The charges are (1) operating a vehicle under the influence and (2) driving with an unlawful BAC (blood alcohol concentration); .08% or higher.</font></font></font></p>
<p>3. <u><strong>Schedule your DMV hearing</strong></u>. On your citation there should be a telephone number to call in order to schedule a hearing to contest the suspension of your drivers license. Depending on the state you only have anywhere from 7 – 10 days to do this! So don’t wait, call and schedule the hearing. You should do this right away, even before you hire a DUI lawyer.</p>
<p>4. <strong><u>Recall the events of your DUI arrest.</u></strong> While it’s still fresh in your mind you should sit down and review the details of your arrest. Make notes of what happened but do not share these notes with anyone especially law enforcement!After you have retained counsel you can share them with him/her as they will be bound by attorney-client relationship and must keep any details confidential.</p>

<p>Judge Somma was arrested after slamming his Mercedes-Benz into the back of a stopped car in New Hampshire.  The judge reportedly told the arresting officer that he had only had 1 drink that evening and was coming from a known homosexual bar out of his home state so he wouldn&#8217;t be recognized.</p>

<p align="left"><strong>The DUI Mix-Up</strong></p>
<p>Apparantly, after he was convicted of DUI 8 years ago he was sentenced to prison for up to 23 months.  He appealed this sentence and the Pennsylvania Superior Court denied the appeal.  The mix up happened because the Superior Court took 1 year to deny the appeal and the prosecutor&#8217;s office was waiting to hear back from the courts about the appeal before they sent the paperwork on to the prison to admit the man.</p>
<p>In that time the paperwork somehow got lost and he was never processed into jail.  But suddenly this past summer the paperwork mysteriously &#8216;re-surfaced&#8217; and now handled, even though it was 8 years ago and he has not been charged w/ any crimes since.</p>

			<content:encoded><![CDATA[<p>The devil is not in fact hiding in the details anymore&#8230; he&#8217;s now hiding in DUI crimes. </p>
<p>DUI has been made easier and easier to commit by continuously lowering allowable BAC levels, increasing DUI checkpoints, and flat out ignoring Constitutional rights.  More and more people are getting roped into the DUI process by widening what we call &#8220;DUI&#8221; or any other drunk driving related offense like DWI, OUI, OWI, OVI and the like.</p>
<p>On top of the broadening of <a title="DUI laws" href="http://www.duiarresthelp.com/states/index.php">DUI laws</a> legislators and lobbying organizations (uh, cough&#8230; MADD&#8230;) are churning out tons of propaganda and media hype to put the devil in DUI, or ruining the reputations of people that get busted with this moving target of a crime.</p>
<p>It&#8217;s easy to hate someone convicted of DUI because the propaganda tells you that these are BAD people, people that kill innocent children, people that put you at risk.. right?  It&#8217;s the devil hiding right smack in the middle of DUI.  But what isn&#8217;t being told is that the people stuck in the DUI system are you, me, your grocer, your pharmacist, your tax guy, your real estate agent, your boss, your school teacher, etc&#8230; </p>
<p>My neighbor got a DUI because his kids asked him to move his car because they wanted to play basketball (his car was in the driveway below the basketball hoop).  He had a couple beers with his wife on their back deck while grilling hot dogs and hamburgers and moved his car from the driveway to the street.  (Note:  At the rate DUI laws are expanding I wouldn&#8217;t be suprised to see patrols specifically designed to look for people simply moving cars out of their driveway for DUI). </p>
<p>Just remember that the &#8220;devil&#8221; resides in all of us because as DUI laws continue to expand everyone has the potential to end up in a DUI trap. </p>

<p>Often times it seems unrealistic to think that you can <em>beat a DUI</em> case due to all of the initial commotion and turmoil that you go through when first arrested on suspicion of drunk driving charges.  You&#8217;re subjected to jail time, impending court dates, license suspensions, vehicle impounding, MADD impact panels, and on and on and on&#8230; </p>
<p>It makes you think that maybe the system has this so streamlined that there really is no way to beat a DUI arrest.  But that just isn&#8217;t the case.  There are many avenues to explore regarding a DUI arrest.  Now, if you&#8217;re guilty you&#8217;re guilty&#8230; you can choose to accept your punishment <em>or</em> you can look to see whether or not the officer followed the proper procedures in regards to your rights.</p>
<p>Even if you were technically driving over the legal limit, your DUI can be thrown out if the police officer didn&#8217;t follow proper procedure and allow you your constitutional rights.  Yes, even if you were guilty if proper procedure was not followed you can beat your DUI case.  So how do you know what proper procedure is&#8230; and how do you know if you have a case?  Let&#8217;s discuss that right now.</p>
