| ok. I'll try again. I really need some advice. Because if they suspend my liscence (again) for this interlock violation, I'm considering driving anyway... I don't know what else to do. I will have no way to get to work/pay bills, feed my child. My lawyer said the da wont dismiss because "she's habitual".... what are the consequences? Please someone get in touch with me... |

In colorado the DMV considers a repeat offense to be an incident within 5 years of a prior incident. So if your DUI was more than 5 years your drivers license suspensions will be treated as a first offense.
The criminal offenses go back for lifetime meaning that in the state of Colorado a prior offense is considered forever and not just for a certain time frame.
To get the "habitual traffic offender" classification in Colorado you must have 3 major traffic incidents involving alcohol. Meaning 3 DUI or 3 DWAI, etc...)
A habitual traffic offender classification carries a 7 year drivers license suspension.
If you are facing a habitual offender classification please seek the help of a qualified Colorado DUI lawyer. It is never wise to run, that only makes problems worse.

| Thank you so much, Guest. I've had 3 duis, my last in Dec of 2003. But have had an interlock for a little over a year... drove another vehicle (no interlock) and was pulled over. It was an emergency situation, but I was ticketed anyway "interlock violation"-non alcohol related. I was supposed to have the interlock from 2005 to 2010... do you know what I'm looking at now? Jail? Dr lisc revocation? |
