DUI is the crime of driving under the influence of alcohol and/or drugs. The legal blood alcohol (BAC) limit in each and every state across the United States is currently set at .08%. Meaning that if you are caught operating a motor vehicle with a BAC of .08% or greater than you will be arrested on suspicion of DUI. The blood alcohol level is most commonly determined by a DUI breath test called an Intoxilyzer test, which refers to the machine that is used to perform the breath test.

When arrested for DUI most drivers are usually charged with 2 separate offenses, the first being the criminal charge of drunk driving and the second being an administrative action against your driving privileges. This administrative action is commonly known as the 'per se' law. The per se law basically says that the DMV can administratively suspend your driving privileges if you are found to be operating a motor vehicle at or above the legal limit of .08% BAC. No evidence of impairment is necessary in this instance... just by operating the motor vehicle at or above the allowable limit enables them to suspend or revoke your driving privileges.

After a drunk driving offense your auto insurance will be affected by being required to carry a specialized high risk policy referred to as an SR22 insurance policy. This is a state specific form that is basically an agreement between the insurance company and the DMV requiring that the high risk insurance company inform the DMV if for any reason your coverage lapses or cancels. In that case the DMV will suspend your drivers license for failure to comply with the mandatory insurance requirment.

When facing a DUI charge it is important to learn the state specific drunk driving laws that you will face and to seek qualified representation.  If this is your first DUI offense you will not face as severe fines and penalties as someone with multiple DUI offenses.
