Arizona Non Owner SR22 Insurance Information

DUI laws and penalties, fines, license suspension, sr22 filing

SR22 insurance is a liability only insurance that many states require of certain "high-risk" drivers. Arizona requires SR22 insurance from anyone who has had his or her driver's license suspended for any of the following reasons:

  • Driving Under the Influence (DUI)
  • Implied Consent Violation
  • Mandatory Insurance Violation

If one does not own a vehicle, but has an SR22 requirement, he or she will have to purchase an Arizona non-owner SR22 insurance policy. Non-owner SR22 insurance only covers other drivers and their vehicles in the event of a future accident. It does not cover the SR22 driver or the vehicle he or she is driving.

Arizona Non-Owner SR22 Insurance and DUI

Those who are required to file an SR22 form because of a DUI conviction may not be able to file a non-owner SR22 form.

Here's why: ARS 28-1461 states that when one is convicted of a DUI, he or she must have an ignition interlock device (IID) installed in each vehicle that he or she operates, even if he or she is not the registered owner of the vehicle(s). The DUI offender is restricted to ignition interlock driving for at least one year from the date that his or her driving privilege is reinstated or from the date the DMV receives the report of conviction, whichever occurs later.

If you do not own a vehicle, you will need to either have an IID installed in someone else's vehicle that you intend to drive, or purchase a vehicle and have an IID installed. In either case, you will need to purchase a traditional SR22 insurance policy, as opposed to a non-owner SR22 insurance policy.

If you do not have a vehicle, and do not have an ignition interlock installed on a vehicle that you do not own, your driver's license will remain suspended or revoked until you have an interlock installed in a vehicle.
