South Dakota requires certain "high-risk" drivers to carry SR22 insurance. This includes those convicted of DWI, Failure to Pay a Judgment, Operating without Insurance, or Vehicular Homicide. You will also be required to carry SR22 insurance if you are convicted of Reckless Driving twice in one year.

If you have an SR22 requirement, and you do not own a vehicle, you will need to purchase non-owner SR22 insurance. This is sometimes referred to as an operator's policy.

SR22 insurance involves the filing of an SR22 form with the Department of Public Safety. This SR22 form serves as proof of future financial responsibility. As long as you have this form on file, the DPS knows that you will be financially responsible in the event of a future accident. If you do not own a vehicle, you would file what is known as a "non-owner SR22 form."

South Dakota requires SR22 insurance for three years. If you have a non-owner SR22 on file, and during those three years, you acquire a vehicle or regular access to a vehicle, then you will need to switch to an owner's SR22 policy, and have your new SR22 filed before the old one is canceled.

If your insurance company notifies the State that your SR22 is canceled (and you don't have a new one on file), your driver's license will be suspended again.
