A Wisconsin OWI is described in Wisconsin DUI statute 346.63 Operating Under the Influence of intoxicant or other drug. It states that no person may drive or operate a motor vehicle while under the influence of an intoxicant, a controlled substance or any combination of the 2 to a degree which renders him or her incapable of safely driving.

Blood Alcohol Content (BAC) Testing

If you are driving in Wisconsin, you are automatically indicating that you will submit to blood alcohol content testing if an officer should suspect that you are driving drunk. You can refuse to take this test, but if you do you are facing a one-year license suspension, and a thirty-day wait before you can get a limited license to drive to work. Occupational Licenses

In Wisconsin OWI first offense cases the arrestee can immediately apply for an occupational license, which will allow him or her to drive to and from work. However, on second and third offenses there is a waiting period before you can apply for this license. You will submit your application with a $40 fee to the Division of Motor Vehicles service center.

  • Drivers license suspension for 6-9 months

Second Offense

  • Jail time between 5 days and 6 months
  • Fines between $350 and $1100
  • $335 surcharge
  • Drivers license suspension from 12 to 18 months
  • Alcohol assessment, education and treatment

Third Offense

  • Jail time from 30 days up to 1 year
  • Court fines between $600 and $2000
  • $355 surcharge
  • Drivers license suspension for 2 to 3 years
  • Alcohol assessment, education and treatment
  • Ignition interlock device
