What is California SR22 Insurance?

SR22 Insurance is a certificate of liability proving financial responsibility. In most cases the Insurance Company will file the SR22 form directly with the California DMV.

You can verify this with your Insurance Agent. Since 2006, State of California insurance companies are required by law to report private-use insurance information. A few serious traffic violations that may require you to carry SR22 Insurance are as follows:

  • Driving without insurance
  • Driving under the influence
  • Driving with a suspended license

What if I do not own a car, do I still need California SR22 Insurance?

Put simply, yes. In order to reinstate your driving privileges after a DUI offense in California or another serious traffic violation if you do not own a car but still need to drive, you will be required to obtain a Non-Owners SR22 Insurance policy in California. A non-owners policy is basically a liability only policy specifically for individuals that do not own a vehicle but need insurance to reinstate their driver's license.

How long am I required to carry my SR22 Insurance?

Under normal circumstances, you will be required to maintain your SR22 Insurance for 3 years. If at any time during the 3-years there is a lapse in your SR22 filing, your 3-year required filing period will have to start over from the beginning and you will need to maintain it for an additional 3-years without interruption.

For instance, if within the second year you allow your SR22 Insurance to lapse, you will need to pay any late premiums on your SR22 policy and your insurance provider will have to perform another SR22 filing with the DMV and then your 3-year filing period will begin on the date your insurance provider resubmitted your SR22 filing to the DMV.

What is the process to reinstate my driver license?

Your driver’s license will be returned to you at the end of your suspension period provided you pay the re issuance fee of $125 and provide proof of financial responsibility in the form of an SR22 filing with the DMV. You will also have to show proof of enrollment in an approved DUI program. If this is your 2nd or 3rd offense, the requirements will include an Ignition Interlock Device, Restricted License (if applicable) and California SR22 Insurance.

For a fourth or subsequent DUI offense within a period of ten years, you may be facing felony charges. Those penalties are severe and include jail time, hefty fines, permanent loss of your license and more.

If you are unsure if you need an SR22 filing, you can contact the California DMV in Sacramento at 1-916-657-7780 and speak with a DMV representative to determine if you are eligible to have your license reinstated.

What is a California Administrative Hearing?

An Administrative Hearing is a proceeding used to contest a suspension or revocation of your driver license. You must request a hearing within 10 days of receiving your Notice of Suspension from the arresting officer or within 14 days from the date the suspension or revocation order was mailed, if the arresting officer failed to issue you the notice. It is important that you make a timely request. If you do not, you will lose your right to an administrative hearing.

At an Administrative Hearing you have the following rights:

  • To be represented by an attorney. It is not required. If you choose to have an attorney present, it is at your own expense.
  • To review the evidence and cross examine all witnesses the DMV calls.
  • To present evidence and witnesses on your own behalf.
  • To testify on your own behalf.
