Minnesota DWI Class Requirements for DWI Offenders
In Minnesota, DUI offenders are required to attend DUI classes as part of their penalty and rehabilitation process. The requirements vary based on the specifics of the offense, such as blood alcohol concentration (BAC) and prior offenses. Here are the general DUI class requirements:
- First-Time Offenders:
- Chemical Health Assessment: Offenders must complete a chemical health assessment to determine their need for treatment or education.
- DUI Education Classes: Typically, first-time offenders with a BAC under 0.16% must complete a state-approved DUI education program. This program includes classes on cognitive therapy, self-assessment, and attendance at a Victim Impact Panel to hear from individuals affected by DUI incidents.
- Ignition Interlock Device: For offenders with a BAC of 0.16% or higher, or those who refuse a BAC test, the installation of an ignition interlock device may be required to regain driving privileges.
- Repeat Offenders:
- Longer DUI Education Programs: Second-time offenders and those with higher BAC levels must undergo more intensive education and treatment programs. These programs aim to address underlying issues and prevent future offenses.
- Extended Use of Ignition Interlock Devices: Repeat offenders are often required to use ignition interlock devices for extended periods, ranging from one to six years depending on the number of offenses.
- Administrative Penalties:
- License Suspension: Offenders face administrative penalties, including license suspension. For a BAC under 0.16%, the suspension can be 90 days with restricted privileges available through the use of an ignition interlock device. For higher BAC levels or refusal to take a BAC test, the suspension period is one year with the option of restricted driving using an ignition interlock.
- Reinstatement Requirements:
- To reinstate a driver’s license after a DUI offense, offenders must pay a reinstatement fee, pass a DWI knowledge test, complete a driver’s license application, and fulfill any other court-imposed requirements, including the completion of a chemical health assessment program.
