The majority of first time DUI offenders in Illinois will be required to attend a 10 hour DUI Risk education class. The 10 hour class is designed for those who have been deemed as non-problem users, hence most first time offenders. Illinois DUI Class Requirements for DUI Offenders
In Illinois, DUI offenders are required to complete specific classes and treatment programs based on their assessed risk level. Here are the key requirements:
- Risk Evaluation: Offenders undergo an evaluation that includes reviewing their driving history, chemical test results, and an interview about their alcohol and drug use. This evaluation determines their risk level: Minimal, Moderate, Significant, or High Risk (Ktenas Law) (DHS Illinois).
- Class Requirements by Risk Level:
- Minimal Risk: Completion of a minimum of 10 hours of DUI Risk Education.
- Moderate Risk: 10 hours of DUI Risk Education and 12 hours of early intervention, provided over at least four weeks.
- Significant Risk: 10 hours of DUI Risk Education and 20 hours of substance abuse treatment, followed by participation in a continuing care plan.
- High Risk: 75 hours of substance abuse treatment and adherence to a continuing care plan (Ktenas Law) (Northern Illinois Recovery Center) (DHS Illinois).
- Consequences of Non-Compliance: Failure to complete the required evaluations and programs can lead to denial of driving privileges, additional evaluations at the offender’s expense, and potential delays in sentencing or license reinstatement (DHS Illinois).
- Costs: The cost of the evaluation and required programs varies, and offenders are responsible for these expenses. Reduced fees may be available for those who can demonstrate financial need (DHS Illinois).
