What is an Alabama Administrative Hearing?

If you have received a notice of intended suspension, you can request for an Alabama Administrative Hearing. We recommend contacting an Alabama attorney that specializes in DUI/DWI cases. An Administrative hearing must be requested in writing and hand delivered to the Alabama Department of Public Safety, Driver License Division in Montgomery Alabama or mailed/postmarked within 10 days of the notice of intended suspension.

An Administrative Hearing will be scheduled as quickly as possible but no more than 30 days after a hearing request was filed. A written notice of the hearing time and place will be sent to you at least 5 days prior to your scheduled hearing unless both parties agree to waive this requirement.

Failure to request a hearing within 10 days of receipt of the notice of intended suspension constitutes a waiver of the person’s right to an administrative hearing. Please note that filing a request for a hearing does not prevent the suspension of the driver license. In order to prevent the suspension of your license you and your lawyer must contest the suspension at the administrative hearing and have the suspension dismissed.
